Trademark Renewal in India

A trademark registration in India is not permanent — it lasts ten years, and then it must be renewed to stay in force. Trademark renewal is how you keep the exclusive rights you worked to secure, indefinitely, in ten-year cycles. Miss the deadline and your mark can be removed from the Register, leaving the brand you built exposed. At ZenPoint, renewals are tracked and filed by a practising advocate, so a registration you spent time and money securing doesn’t quietly lapse through a missed date.

How long a trademark lasts in India

Under the Trade Marks Act, 1999, a registered trademark is valid for ten years from the date of registration. It can then be renewed for successive ten-year periods, with no limit on how many times — a trademark, properly maintained, can last forever. Renewal keeps your registration, and all the rights that come with it, fully in force: the exclusive right to the mark, the ability to license or assign it, and the standing to enforce it against infringers. The register of live marks is maintained by the Trade Marks Registry, where each registration carries its own renewal date.

What happens if you miss the renewal deadline

This is the part that catches brand owners out. If a renewal isn’t filed in time, the mark doesn’t disappear overnight, but it does become vulnerable — the Registry can remove it from the Register, and once removed, the protection is gone. There is a limited window to restore a removed mark, but restoration is more expensive and less certain than a timely renewal. The lesson is simple: renewing on time is far cheaper and safer than trying to recover a mark after it has lapsed.

The renewal window — and why early is better

Renewal can be filed in advance of the expiry date, and doing so is the safest approach. The law also allows a grace period after expiry during which renewal is still possible on payment of an additional fee, and beyond that, a further limited window for restoration. But every stage past the deadline adds cost, risk, and uncertainty. The single best protection for a valuable registration is to renew before it expires — which is why deadline tracking matters as much as the filing itself.

The renewal process, step by step

  1. Track the deadline. The foundation of renewal is knowing when it’s due. We record your registration’s expiry and flag it well in advance, so the date never arrives unnoticed.
  2. Confirm the details. We verify the registration particulars — mark, classes, proprietor — so the renewal is filed cleanly against the correct record.
  3. File the renewal. The renewal application is filed with the Registry, with the applicable government fee, before the deadline.
  4. Confirm the record. We ensure the renewal is reflected on the Register, so your rights continue without a gap.
  5. Set the next reminder. The next ten-year deadline goes on record immediately, so the cycle is never left to memory.

Renewal is part of protecting a portfolio

For a business with more than one registered mark, renewal is not a one-off task but an ongoing responsibility — different marks registered on different dates, each with its own ten-year clock. Missing any one of them can cost you a brand. This is why renewal sits naturally alongside brand protection advisory: keeping your existing rights alive, while watching for new threats to them. Together they form the maintenance layer that protects everything you’ve registered.

If your mark has already lapsed

If you’ve discovered that a registration has expired, don’t assume the brand is lost. Depending on how much time has passed, renewal within the grace period or restoration of a removed mark may still be possible. The sooner you act, the better your position — these windows are limited and they close. Send us the details and we’ll tell you honestly whether the mark can still be saved and what it will take.
