STAGE 1
Day 1 to Week 1
Trademark search to check for conflicts. Application preparation and filing with IP India. Filing number issued immediately on submission online. You can use the TM symbol from this date.
STAGE 2
Week 1 to Week 4
IP India reviews the application for completeness. Minor deficiencies may be raised. This stage is typically completed within 2 to 4 weeks of filing.
STAGE 3
Month 3 to Month 12
A Trade Marks Examiner reviews the application. Standard examination takes 6 to 12 months. Expedited examination (Rs 20,000 additional fee) significantly reduces this stage.
STAGE 4
Month 6 to Month 18
If accepted, the mark proceeds to publication. If objections are raised, you receive an examination report and must respond within 30 days. A hearing may be required.
STAGE 5
After Acceptance
Accepted marks are published in the Trademark Journal. This opens a 4-month opposition window during which any third party can oppose registration of your mark.
STAGE 6
4 Months from Publication
If no opposition is filed within 4 months, the mark proceeds to registration. If opposed, proceedings can add 12 to 36 months depending on complexity.
STAGE 7
Month 18 to Month 36
Once all stages are clear, IP India issues the Registration Certificate. The mark is valid for 10 years from the filing date and is renewable indefinitely.
